Negotiating an agreement before resorting to The Courts.

We prefer to go straight to court to solve family disputes.  However, if it can’t be fixed, we have the knowledge and experience to provide strong representation in the family court. We know that going to court is stressful. Our approach is to offer prompt and efficient resolution of family disputes such as.

It is usually better for all parties to settle out of court. We have experience in negotiating with ex-partners to attempt to reach an amicable agreement without the pain and expense that can arise from a lengthy court battle. Should you be unable to reach an agreement outside of the courtroom, we will firstly give you an honest appraisal of what we believe to be the likely outcome of a court case, and the expected legal costs involved in obtaining it. Should you decide to go to court, we will fight on your behalf to ensure that you get the most favourable outcome without losing sight of the one thing that matters the most, your children.


Going to court

This should be the last option you try, when all other forms of negotiations fail or when you want a binding decision.  We can assist with such things as:

  • Negotiating an agreement with your ex-partner in regard to property and/or your children’s custody issues
  • Obtaining Court Orders to set out any agreement reached between you and your ex-partner
  • Negotiating a formal Binding Financial Agreement about property issues
  • Applying to the court for appropriate orders in circumstances where no agreement can be reached

If there are court orders in regard to your children, and your ex-partner is not complying with them, we can apply to the court for what are known as “Contravention Orders”. If you are thinking about entering into a relationship or marriage with someone, we can help you to prepare an agreement that states what is to happen with property if you or your partner or spouse separate in the future. To maximise the effectiveness of such an agreement, it should be done as early as possible and not left to just before the marriage ceremony. We can also help you with
